Background: For years, tenants at 169 Starr Street have lived with gaping holes in their floors, constant leaks and a broken front door. Since 2012, Monica, a Bushwick activist, and small business owner fought her landlord, Joshua Bail of Cardan Realty to have several repairs done in her apartment. 386337. After years going without repairs, Monica began to withhold her rent in May 2017.
Joshua Bail responded by brutally and illegally evicting Monica from her 169 Starr Street apartment at 9:30 am on Monday, October 30th, 2017. Without properly serving Monica with the appropriate paperwork from Kings County Civil Court, Joshua Bell started eviction proceedings against her. Monica never received any court documents so was completely unaware of her court dates. Without ever appearing in front of a judge, Monica learned the eviction on October 30th, when Joshua Bell and two Kings County marshals violently forced their way into her apartment at 9:30 am and ordered her to leave. They taunted and videotaped her, as she scrambled to get a bag of clothes and her dog.
